[2022/09/11 12:10] Agatha Macbeth: There was a LUC Meeting yesterday (September 10). The following is a brief report on the points that were discussed:
[2022/09/11 12:10] Agatha Macbeth: 1) A real pathway to the catacombs in Colonia Nova:
[2022/09/11 12:10] Agatha Macbeth: A plan has been made and a proposal written to present to the Chancellor. The proposal was voted on by the LUC and will be sent to the Chancellor for approval so we can get his permission to start work. Development will commence as soon as we have approval.
[2022/09/11 12:10] Agatha Macbeth: (Hopefully Tor will say yes! :)
[2022/09/11 12:11] Agatha Macbeth: The current terrain will be removed and replaced with prim land which can be done quickly, but replacing the theater will take longer.
[2022/09/11 12:11] Agatha Macbeth: Consequently either the landforms will need to temporarily fit with the existing theater or the theater will be replaced first, whichever suits the builders best.
[2022/09/11 12:11] Agatha Macbeth: Moon has volunteered to do the theater and has already begun the process of collecting visual references. Sudane will do the terrraforming. The tunnels will be a collaborative project.
[2022/09/11 12:12] Agatha Macbeth: Moon says she will present a few pictures at the next LUC meeting.
[2022/09/11 12:12] Agatha Macbeth: Hopefully the entire project can be completed or at least moved forward a lot by the end of this term (December 1).

[2022/09/11 12:13] Agatha Macbeth: At the last meeting our plan was to find suitable places in all our regions; yesterday was to decide which signs we wished to use and the next step, but not least, will of course be to actually make them and the notecards to go with them.
[2022/09/11 12:13] Agatha Macbeth: Three different styles of sign were up for consideration and Rosie's design was chosen. This form of sign is on the heritage rocks and a few other locations already, so is proven to work well within its environment.
[2022/09/11 12:13] Agatha Macbeth: The follow-up on landing places was tabled until next meeting as Sudane had to leave at this point. Next LUC meeting is scheduled for October 1.

The RA's work on the Constitution Revision is done and the final draft has been published within the legal time before voting. See Jerry's post of September 3, 2022 in the thread https://forums.slcds.info/viewtopic.php?t=9954.

[2022/09/11 12:32] Almut Brunswick: Today (!), we just received a modification proposal to Article III, Section 3 (b) from the SC:
[2022/09/11 12:32] Almut Brunswick: Proposed addition/modification.

3 (b) New members are nominated by the Chair and approved by a simple majority vote of the members of the SC. New SC appointees are confirmed by a simple majority vote of the RA; where a member of the RA votes against the appointment, he or she will provide a rationale for their decision, based on the nominee’s knowledge and understanding of the Constitution and Laws, and likelihood to uphold said Constitution and Laws without bias, personal preference or emotion.

To members of the RA:

The members of the SC feel very strongly that it is is extremely important to the functioning of the CDS judiciary that members of the Scientific Council be both knowledgeable about and committed to upholding the laws of the CDS. It is in that we request and submit to the RA this modification to Article III, Section 3(b) of the updated CDS Constitution.

I can't imagine an instance when someone would decide against a nominee and *not* provide a reason, but I guess it doesn't hurt to spell it out. Done.

[2022/09/11 12:39] Rosie Gray: #1, this comes to us all today, on the day that we are to vote on the constitution that we have been working to update for months

[2022/09/11 12:41] Rosie Gray: also, just to point out that it is not something in the existing constitution... this clarification that the RA give an explanation if we should reject a candidate
[2022/09/11 12:41] Rosie Gray: I am certainly not opposed to giving reasons... and I think that we should give specific reasons if this should occur
[2022/09/11 12:42] Rosie Gray: but I don't know if we should delay voting on all of the rest of the work we have done in order to entertain it

[2022/09/11 12:46] Almut Brunswick: Thank you. Well, like I said: the timing and style is not optimal for such a statement, politely and frankly said. There was plenty of time before and after posting the draft for the revised Constitution. Lilith contributed her valuable thoughts to our discussions and helped to bring things forward before it became a final draft. Of course, there was and is not an obligation to participate this way, but after publishing the final draft, there was the formal opportunity to add comments like this.
[2022/09/11 12:46] Almut Brunswick: Regarding the content of this proposed modification, let me keep it as short as possible:
[2022/09/11 12:48] Almut Brunswick: 1. All RA members are bound on two things: their sworn oath on the Constitution and their own conscience. Nothing else. They don't need to give any justification of their votes, regardless if they are aye, nay and abstain. And there is no exception to the rule acceptable.
[2022/09/11 12:50] Almut Brunswick: 2. In the case that a proposed SC candidate will not find the approval by the RA due to a majority vote will get a rationale - like any other decision of the RA. It is in our mutual interest to know what has been objected in order to remedy the situation.
[2022/09/11 12:51] Almut Brunswick: But this is a collective rationale then, not an individual one like this proposal wants to oblige our individual members.
[2022/09/11 12:53] Almut Brunswick: 3. I understand the worries of some SC members that some RA weirdos - not in this RA of course, but maybe in the future - would like to sabot the SC's work. However, this assumes that we would need a majority of such oddballs here.
[2022/09/11 12:54] Almut Brunswick: and even so, when you follow 2., the LRA would need to give a rationale for the decision. Show me one decision that has made without good and traceable reasoning in the last terms! - Or in other words: When the relationship between SC and RA is on that low level, we have even yet other, more severe problems.
[2022/09/11 12:55] Almut Brunswick: My conclusion is therefore that I propose to reject this SC proposal and to vote fro the Constitution draft as presented. Thank you!.

[2022/09/11 12:57] Callipygian Christensen: First, It is not for me to presume to know why this was only submittted today, when it was discussed and prepared 2 weeks ago, so for that I apologize on behalf of the SC , although I am not sure why it happened.
[2022/09/11 12:58] Callipygian Christensen: It was a specific decision for the member s of the SC not to comment on the documents indivisually so as not to confuse personal form SC opinions.
[2022/09/11 12:59] Callipygian Christensen: That said, why suggest this amenment? It came from, I believe, a questio raised by Almut(although it may have been smeone else) - 'what if theRA votes no on a candidate?
[2022/09/11 13:00] Callipygian Christensen: Working back from that the question is 'what reasons would there be NOT to vote yes...and they biol down to two braod categories 1. they have done x,y,z and that makes me believe they wont support the Consitution etc..or 2. I don't like, them, nver have or some degree of that.
[2022/09/11 13:00] Callipygian Christensen: Number 1 is a perfectly good reeason for a no vote, number 2 is not.
[2022/09/11 13:01] Callipygian Christensen: Unfortunately we have had, in the past, RA members who would vote on personal feelings and that based, as you are pinting out Almut, on themnothaving to justify their refusal to accept someone.
[2022/09/11 13:02] Callipygian Christensen: So the purpose of this amendment is to be clear to all future RA members and citizens, that in deciding who joins the SC the voting must be objective.
[2022/09/11 13:03] Callipygian Christensen: While I appreicate your suggestion of a group rationale Almut, if people vote no and refuse to tell you why, how would that group rationale be formed?
[2022/09/11 13:04] Callipygian Christensen: I have no probelm if you want to vote on this as a future amendment - vote on exisiting today and add this later..but I do strongly believe that our Consitution should support objective appointment to office where a position is not an elected one.

[2022/09/11 13:05] Almut Brunswick: Like I said and even when we would fully agree your argumentation, we couldn't vote for it today.
[2022/09/11 13:10] Almut Brunswick: Before I will ask the RA members to ratify the Constitution as presented, let me emphasize once again that the SC has no constitutional right to judge the individual decision of the RA members - even when you make a fist in your pocket. This is not what a democracy allows. The reasons under your 2. - the apparently not objective one - may also contain a certain mistrust because that person is not sufficiently known to the RA members and is now presented as formally qualified, This is something to be discussed here and with the SC, too, BEFORE that candidate will be presented for a formal approval at all. Such votes don't come out of the blue.
[2022/09/11 13:11] Almut Brunswick: So there should happen a lot of communication before you surprise us with somebody. I think that is just fair enough.

[2022/09/11 13:12] Tor Karlsvalt: Thank you, First I think a no vote is rather rare. The nominations come to the RA from the SC. I am sure the SC would have vetted the candidate not not moved it forward if there were some serious issue with regard to qualifications. Second, forcing an RA member to offer a rational for his vote, could not only insert drama but offers no purpose. Is that vote to be invalidated if there is no rationale, or if the rationale is insufficient? Tho will judge this?
