[2014/09/08 22:22:29] Michel Manen: the one you just raised the commission of conflicts of interests for which you asked me a question
[2014/09/08 22:22:47] Michel Manen: Thank you. The question of conflicts of interest for our public officials has been on CDS’s agenda in one form or another almost from the inception of this community.
[2014/09/08 22:23:02] Michel Manen: I know it was when I joined, in 2006; it was still an important issue a few years later when a former Chancellor, Jamie Pallisades, drafted a Conflict of Interests law, as Widget helpfully pointed out to me today.

[2014/09/08 22:23:16] Michel Manen: When the RA set up the current commission I was very hopeful that this time, we would finally be able to set the high standards our citizens deserve, and was the first to volunteer to take part in it.
[2014/09/08 22:23:28] Michel Manen: Given the level of … let’s say differences of opinions in the CDS on this topics, it is critical for the success and legitimacy of this Commission not only to be fair, impartial, and inclusive, but to be seen to be so by all our citizens, whatever their individual positions on this topic.
[2014/09/08 22:23:44] Michel Manen: The real and perceived impartiality of the Commission is critical for its success. The RA acknowledged this, which is why it decided that for the first time, a formal RA appointed commission be headed not by a sitting RA member, but by a citizen no currently holding an elected position.
[2014/09/08 22:23:57] Michel Manen: I was satisfied with the LRA’s acknowledgement that her enthusiasm for the commission caused her to rush into announcing the Chair of the commission before this meeting, as required by the clear terms of reference the RA adopted at its last meeting, which clearly stated that Candidates should be presented now and a Chair then selected
[2014/09/08 22:24:10] Michel Manen: I therefore will follow the strict text of the RA and take it as a given that the Commission chair is yet to be appointed, and that more than one Candidate should be nominated at this time, for a choice actually to be made, rather than just a hasty LRA anointment to be ratified.
[2014/09/08 22:24:21] Michel Manen: So what criteria should we have for the Commission chair?
[2014/09/08 22:24:35] Michel Manen: All members appointed on the commission are trustworthy and dedicated individuals who, I am sure, will do their best for the CDS. But, as I have stated, both reality and perception of the commission’s impartiality must be above any doubt for its results to be legitimate with all CDS citizens
[2014/09/08 22:24:47] Michel Manen: Therefore, I propose that the key criterion for selection of the Chair be both his or her real, and especially perceived impartiality. This is critical, since this commission deals with issues related to the very public officials that stand to gain – or lose! – most from the recommendations of this Commission, and who will have to ratify these conclusions and recommendations.
[2014/09/08 22:25:00] Michel Manen: I note, therefore, that 4 out of 5 members of the Commission have run for, and have been elected, to government positions in both the legislative and judiciary branches of the CDS. I am one of them, although my brief tenure as RA member and Vice-Chancellor goes back many years.
[2014/09/08 22:25:12] Michel Manen: I strongly believe that it would be a mistake for the Commission to be headed by any of these four individuals. A Conflicts of Interest Commission making recommendations on critical issues related directly to our elected officials, whose recommendations must be enacted by the RA, simply cannot ALSO be headed by a former elected official if it is not only to be, but also perceived to be by all, entirely objective, impartial, and legitimate.
[2014/09/08 22:25:23] Michel Manen: Therefore, I move that the RA appoint, based on the criteria and concerns expressed above, as Chair of the Commission, the only person of the 5 selected volunteers who has never run for office, or occupied any elected position in the CDS, and who can not only be, but be seen to be, entirely impartial on these delicate and sensitive issues: Abby.
[2014/09/08 22:25:34] Michel Manen: Should she not accept – although I see no reason whatsoever why she should volunteer to be on the Commission, but refuse to do so -, another Citizen should be chosen meeting the same criteria, and be appointed as Chair.
[2014/09/08 22:25:44] Michel Manen: If the RA believes it is so critical to only have five members on this Commission and will not consider adding a sixth one, in the interest of the success and legitimacy of this commission and its recommendations, I am ready to withdraw from it in order to create a free seat to be occupied by such a person.

[2014/09/08 22:25:59] Cadence Theas: It should be up to the commission itself recognizing as you said, the need to be impartial. What I would suggest is a rotating chair
[2014/09/08 22:26:31] Cadence Theas: the chair in this particular commission has more of an administrative role than establishing an agenda per se
[2014/09/08 22:26:39] Cadence Theas: that is the task of the entire commission to avoid
[2014/09/08 22:26:49] Cadence Theas: as you rightly suggest any suggestion of partiality
[2014/09/08 22:27:31] Cadence Theas: before we can vote on your suggestion, the commission itself needs to present the suggestion
[2014/09/08 22:27:33] Michel Manen: i set out clear criteria of what i believe to be essential for the Chair to be impartial. 4 out of the 5 members of the commission do no qualify under these criteria. therefore, the chair shouod be the one person who does or a suitable alternative
